Who is Responsible ? My car was sitting in my own drive way when someone hit the car causing it to hit a wall?

The car was sitting in the driveway out of gear with no hand brake on
It was shunted by someone coming on uninvited onto my property and falling against the bonnet causing the car to roll back and come into contact with a wall.Who is responsible for the resulting damage to the car?
The owner for not having the handbrake on ?
Or
The person who came onto the property uninvited and caused the car damage by falling on the car and therefore shunting it into the wall?

"falling against the bonnet"......it was a pedestrian?

A reasonable person might reasonably expect his car in his own driveway to be reasonably safe from pedestrians.

Other hand, a reasonable person would reasonably expect a car to stay put if he fell against it.

Your car was an accident waiting to happen. What you might call a "dangerous situation".

Did the guy enter a closed gate? Did he have notice from you that he was unwelcome? Did he "fall against the car" in a fit of rage or drunkeness?

If the answer to all these questions is "no", it's your fault.
